3. You must exercise caution and ensure the safe and proper use of rented tools. This includes following manufacturer instructions, safety guidelines, and local regulations.
4. In case of any disputes, claims, or issues related to tool rentals, you are responsible for resolving them directly with the parties involved. [The Journeyman App] is not responsible for mediating or arbitrating such disputes.
5. You agree to indemnify and hold [The Journeyman App] harmless from any claims, liabilities, or expenses arising from your use of the service and any actions or events related to tool rentals. By using the [The Journeyman App] platform, you understand and accept that you rent tools at your own risk and bear the full responsibility for their use and any consequences that may arise.
6. For all itemss rented, it is the renter’s responsibility to research and wear all proper PPE relevant to the use of rented tools.
Tool Rental Website Policy: Responsibility for Damaged or Broken Tools
At Journeyman App, we strive to facilitate a seamless and reliable tool rental experience for all users. Our platform connects individuals seeking tools with those willing to rent them out, fostering a community built on trust and mutual respect. To maintain the integrity of our platform and ensure fair treatment for all users, we have established the following policy regarding damaged or broken tools:
Responsibility of the Renter:
When renting a tool through Journeyman App, renters assume full responsibility for its care and safe usage during the rental period.
Any damage or breakage that occurs to the rented tool during the rental period is the sole responsibility of the renter.
Replacement at Market Value:
In the event of damage or breakage to a rented tool, the renter is obligated to replace the tool at its current market value.
The market value will be determined based on factors such as the condition of the tool prior to rental, its age, and prevailing market prices for similar items.
Notification and Resolution:
Renters must promptly notify the tool owner and Journeyman of any damage or breakage to a rented tool.
Upon notification, Journeyman will facilitate communication between the renter and the tool owner to discuss the extent of the damage and agree on a resolution.
If the tool owner and renter are unable to reach a resolution, Journeyman reserves the right to intervene and make a final determination based on the circumstances of the case.
Failure to Comply:
Renters who fail to comply with this policy may be subject to penalties, including suspension or termination of their account on Journeyman.
Additionally, renters may be held financially liable for any costs incurred by the tool owner as a result of the damage or breakage.
Insurance and Liability:
Journeyman strongly encourages users to consider obtaining appropriate insurance coverage for rented tools to mitigate potential financial risks associated with damage or loss.
Users agree that Journeyman shall not be held liable for any damages, losses, or disputes arising from tool rentals conducted through the platform.
User Agreement:
By using Journeyman and engaging in tool rentals, users acknowledge and agree to abide by this policy as well as the platform's Terms of Service.
Policy Updates:
Journeyman reserves the right to update or modify this policy at any time. Users will be notified of any changes, and continued use of the platform constitutes acceptance of the revised policy.
